Secondary authority, as a result, refers to “authority that describes the law but won't alone establish it, for instance a treatise, annotation, or law-overview report.”39 Though lawyers could cite secondary authorities, courts will not look at secondary authorities as possessing just as much persuasive weight as primary authorities have.
